International Students Seeking Employment in the U.S.

How to work legally in the U.S. is a MAJOR consideration for most international students.

International students who are consider working in the U.S. for more than 12 months must obtain a H-1B visa, a temporary work permit for a maximum of 6 years. H-1B visas are employer-specific.

However, here's the tough news, many international students encounter different challenges when trying to secure postgraduate employment. Some of these include:

Hiring Complexities: Many U.S. employers are not familiar and feel intimidated by rules and regulations that need to be followed when hiring international students.
Perceived Lack of Commitment: Some employers may not want to invest time and money in training international students, only to have them leave after a year.

Communication: Some employers are often concerned with international students' ability to communicate effectively in English with their clients and/or internal personnel.

Timing Restrictions: Many employers may feel reluctant to hire international students once the 12 months time window of their practical training starts running.

Animosity: Some employers feel that, by living and working in the U.S., international students are taking away jobs from Americans.

U.S. ECONOMIC STIMULUS PACKAGE PROVISION: Under the Employ American Workers Act in the U.S. economic stimulus bill, employers that received federal funding from the Troubled Asset Recovery Program (H-1B dependent companies) must take extra steps to hire international workers such as ensuring international hires do not displace U.S. workers. For instance, those companies must attest they have made "good faith" efforts to recruit American workers for positions for which they are seeking H-1B talent. Also, the employers must attest they are offered a minimum of "prevailing wages" during recruitment efforts, have not displaced a U.S. worker within the 90 days before or after filing an H-1B petition and have offered the job to an U.S. worker who applied and is equally or better qualified than the H-1B worker.
